If you are a Missouri citizen who received a debt collection letter from Martin Leigh PC, and its predecessor Martin, Leigh, Laws & Fritzlen, PC between 2007 and the present where Martin Leigh PC was acting on behalf of a debt purchaser, a class action lawsuit may affect your rights.
You may be affected by a class action lawsuit about whether Martin Leigh PC violated Missouri’s Merchandising Practices Act by deceiving, concealing, suppressing, or omitting from Missouri citizens material facts related to the debt purchaser’s absence of a legal right to enforce the alleged debt and charging excessive fees along the way from 2007 to the present.
The lawsuit is called Yvette Baker v. Ocean 18, LLC, et al., Case No. 1816-CV32043, and is in the Circuit Court of Jackson County, Missouri at Kansas City. The Court decided this lawsuit should be a class action on behalf of a “Class,” or group of people, that could include you. This notice summarizes your rights and options before an upcoming trial. More information is in a detailed notice available by request by calling the toll-free number below. If you are included in the Class, you have to decide whether to stay in the Class and be bound by the results or ask to be excluded and keep your right to sue Martin Leigh PC. There is no money available now and no guarantee that there will be.
All Missouri citizens who received a debt collection letter from Martin Leigh PC, and its predecessor Martin, Leigh, Laws & Fritzlen, PC between 2007 and the present where Martin Leigh PC was acting on behalf of a debt purchaser are Class members.
Plaintiff in this lawsuit claims that Martin Leigh PC violated Missouri’s Merchandising Practices Act by deceiving, concealing, suppressing, or omitting from Missouri citizens material facts related to the debt purchaser’s absence of a legal right to enforce the alleged debt and charging excessive fees along the way from 2007 to the present.
The Court has not decided whether Martin Leigh PC or the Class is right. The lawyers for the Class will have to prove their claims at a trial to be scheduled in the future.
The Court approved the law firms of Gregory Leyh, P.C. to represent you as “Class Counsel.” You do not have to pay Class Counsel, or anyone else, to participate. Instead, if Class Counsel get money or benefits for the Class, they may ask the Court for attorneys’ fees and costs, which would be paid by Martin Leigh PC or out of any money recovered, before giving the rest to the Class. You may hire your own lawyer to appear in Court for you; if you do, you have to pay that lawyer. Yvette Baker is a Class member like you, and the Court approved her as the “Class Representative.”
